The designated ATTMA employee should not have\u00a0been part of the certification \/ assessment process of which the complaint is being\u00a0raised against.<br \/>In cases where the complainant is not satisfied with the review and decision made\u00a0regarding the complaint, they may consider raising an appeal.<br \/>All appeals are managed by the ATTMA Chairman, or a designated employee\u00a0assigned by them. The appeals process is described within section 5 of this\u00a0document.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3da9d9a elementor-widget elementor-widget-heading\" data-id=\"3da9d9a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Re-evaluation<\/h6>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-abd3266 elementor-widget elementor-widget-text-editor\" data-id=\"abd3266\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Where an applicant, candidate, or certified company disagrees with a decision\u00a0made by ATTMA regarding their certification, or the assessment process, they must declare in writing the reasons for the disagreement to ATTMA and ask for a re-evaluation.<br \/>This request must be made within 30 days of the issuance of ATTMA\u2019s initial\u00a0decision. Re-evaluation requests received after 30 days will not be reviewed.<br \/>Requests for re-evaluation are not considered by ATTMA to be complaints.\u00a0<br \/><span style=\"font-size: 16px; text-align: var(--text-align);\">Where applicants, candidates, or certified company still disagree with the findings of\u00a0<\/span><span style=\"font-size: 16px; text-align: var(--text-align);\">a re-evaluation decision from ATTMA, they should submit a formal certification\u00a0<\/span><span style=\"font-size: 16px; text-align: var(--text-align);\">complaint in writing to ATTMA.<br \/><\/span><span style=\"font-size: 16px; text-align: var(--text-align);\">This complaint must be made within 30 days from the issuance of the re-evaluated\u00a0<\/span><span style=\"font-size: 16px; text-align: var(--text-align);\">decision. Complaints relating to re-evaluations received after 30 days will not be\u00a0<\/span><span style=\"font-size: 16px; text-align: var(--text-align);\">reviewed.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6812eee elementor-widget elementor-widget-heading\" data-id=\"6812eee\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Certification Complaints<\/h6>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-42bc037 elementor-widget elementor-widget-text-editor\" data-id=\"42bc037\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Certification complaints \/ assessment complaints should include personal or business information (full name, address, contact details) of the complainant, and<br \/>the complainant\u2019s personal opinion about the assessment \/ decision, the reasons for disagreement with the decision reached during the initial decision re-evaluation, as well as the outcome being sought. ATTMA will issue an acknowledgement of the complaint within 5 working days (where practicable).<br \/>As previously referenced, certification complaints will be managed by the Scheme Manager, or a designated ATTMA employee assigned by them. The designated\u00a0employee should not have been part of the certification \/ assessment process of\u00a0which the complaint is being raised against. The complaint manager should\u00a0consider the complainant\u2019s explanation and evidence and provide a written\u00a0response.<br \/>The complaint manager should issue their response within 90 days (where practicable). This response timeframe takes into account the complexity of the case in situations where the case involves multiple parties and necessitates a more\u00a0comprehensive investigation.<br \/>If the complainant agrees with the outcome at this stage, the complaint process does not need to proceed further.<br \/>If the complainant is not satisfied with the outcome, then they may choose to file an\u00a0appeal. This should be made within 30 days of the issuance of the ATTMA\u2019s formal\u00a0decision.<br \/>If required, ATTMA will take appropriate corrective actions which will be logged in\u00a0accordance with \u2018CAA001 \u2013 Corrective Actions Policy\u2019.<br \/>All certification complaints, including actions taken will be tracked and recorded\u00a0within ATTMA\u2019s QMS.<br \/><i>Note: The submission, investigation, and the decision on certification complaints will not\u00a0result in any discriminatory actions against the complainant.<\/i><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4bda928 elementor-widget elementor-widget-heading\" data-id=\"4bda928\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Raising a Certification Complaint<\/h6>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9117028 elementor-widget elementor-widget-text-editor\" data-id=\"9117028\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Complaints should be reported to the Scheme Manager either by:<br \/>\u2022 Email: manager@attma.org.uk<br \/>\u2022 In writing to: The Scheme Manager, ATTMA, Unit 3 Tannery Road Industrial Estate, Loudwater, Buckinghamshire, HP13 7EQ<br \/>Complaints should include the following information:<br \/>\u2022 Complainant name.<br \/>\u2022 Address of complainant.<br \/>\u2022 Contact details (telephone and email).<br \/>\u2022 Availability for feedback (preferred time to discuss feedback \/ research the complaint further etc.).<br \/>\u2022 Nature of the complaint<br \/>If the complaint is concerning another scheme member company or registered\u00a0tester, the following additional information is also required:<br \/>\u2022 The ATTMA membership number (if known) and\/or name of the tester who carried out the works.<br \/>\u2022 The task and\/or test number if available.<br \/>\u2022 The date the test was undertaken.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-feb877f elementor-widget elementor-widget-heading\" data-id=\"feb877f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Appeals Process<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-60764ea elementor-widget elementor-widget-text-editor\" data-id=\"60764ea\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Where complainants disagree with ATTMA\u2019s finding and decisions regarding the\u00a0certification complaint, they then may proceed to the appeal stage, explaining the\u00a0reasons for disagreement.<br \/>Appeals should be lodged made within 30 days of the issuance of the ATTMA\u2019s\u00a0formal decision.<br \/>The appeal should include the complainant\u2019s personal opinion about the\u00a0assessment, the reasons for disagreement with the decision reached during the<br \/>initial decision re-evaluation, as well as the outcome being sought. ATTMA will\u00a0issue an acknowledgement of the complaint within 5 working days (where\u00a0practicable).<br \/>All appeals are managed by the ATTMA Chairman, or a designated employee\u00a0assigned by them. The designated ATTMA employee should not have been part of the initial complaint or investigation.<br \/>There will be an advance fee lodged before an Appeal with a value commensurate\u00a0with the financial risk assessed with the particular Appeal. Should this Appeal be successful, the advance fee will be returned. This is typically the cost of the time of\u00a0the independent as quoted.<br \/>The complainant may choose to object to the Independent, giving a clear reason as\u00a0to why the objection has taken place.<br \/>Should the complainant and the Scheme not agree an Independent, ATTMA will\u00a0pass the complaint to the Government of the country that the complainant is complaining about. For instance, if the complaint is regarding an ATTMA member company in Scotland about work carried out in Scotland, ATTMA will pass on<br \/>details of the initial complaint, and details of ATTMA\u2019s attempts to resolve the issue to the Scottish Government.<br \/>5.1.8 The appeal manager should issue their response within 90 days (where practicable). Provide suitable help and assistance\u00a0when dealing with vulnerable people.<br \/>\u2022 Co-operate fully with TrustMark and its appointed agents on any dispute\u00a0handling issues and provide related documents and statements upon request.\u00a0Where it is deemed necessary by TrustMark to commission an independent\u00a0site visit\/survey, associated costs may be charged back to the Scheme\u00a0Provider.<br \/>\u2022 Where TrustMark, or its appointed agents engage with a Scheme Provider, the Scheme Provider shall conclude the issue directly from the point of\u00a0TrustMark engagement and in a period not exceeding 3 months, unless otherwise stipulated by TrustMark.<br \/>\u2022 Ensure robust arrangements are in place to support consumers if a\u00a0Registered Business unreasonably refuses to co-operate with the Scheme\u2019s\u00a0disputes investigation or dispute resolution process &#8211; this can only occur if prior permission has been granted. For example, provide the consumer with a\u00a0summary of findings and\/or statements to support their claim or identify alternative tradesman to rectify and\/or complete the work and provide the\u00a0consumer with the remediation plan.<br \/>\u2022 A Scheme Provider may choose to suspend actions within the dispute resolution process if either party to the dispute takes legal action.
